Traditionally, scholarship has been suspicious and dismissive of'emotion' in decision-making, regarding it as a rather dangerous and irrational force to be kept in check.However, in more recent times interesting work has been emerging which has, in effect, sought to 'rehabilitate' emotion in academic (and policy) thinking. Examples include but are not limited to: Cathartic and therapeutic forms of justice The deployment and interaction of displays of rationality and emotion in the use of discretionary decision-making The use of emotion to gain knowledge about defendants, witnesses and others Emotion in public sentiment and attitudes Emotional labour in judicial (and other practitioner) work The institutionalisation of emotional expression The emotional management of Inter- and intra-professional interaction Emotional empathy and ethics of care Efficiency and emotion Gender and emotion in decision-making processes Psychoanalytic approaches and penal practices The emotional life of decision-making research Despite the renewed attention shown by various disciplinary approaches have shown to emotions in recent years, it continues to be a greatly underestimated dimension in sentencing and other penal decision-making processes. While we know quite well today that emotions do matter, we know little about how they matter, or indeed, howthey should matter in the context of sentencing and other forms of penal decision-making. With these needs in mind, this symposium aims to examine a range of questions including for example: What role do, and should, emotions have in sentencing and penal decision-making? Are rationality and emotion discrete elements and if so, is the difference between them knowable? If not, what are the implications? How do and should rationality and emotion interact? How can decision-makers better understand the emotional life of those they judge? How do individual and multi-judge sentencing panels differ in their use of emotion? Do emotions, and should, emotions play different roles in civil and common law traditions in practice? What is, and should be, the role of emotion in academic research into sentencing and penal decision-making processes? These questions are intended to be indicative only - a way of stimulating further thought and to help to focus and encourage proposals for papers. There will be further, (and no doubt better), questions raised by participants. Abstracts should be 200-500 words in length. Papers can be wholly conceptual, empirically based (whether by quantitative or qualitative work) and inspired by one or more disciplines. There will be relatively generous time devoted to discussing the implications of the work presented (see below), but given that the symposium is itself relatively short, a selection of papers may have to be made for example on the basis of preference for work at a relatively mature stage of completion. The language of the symposium will be English. Native English-speakers are reminded to bear in mind that others will be listening and speaking in another language. If you are presenting this means that you should try to speak just a little more slowly than you normally would. Round-Table Format Even if you are not scheduled on the programme to present, you are regarded as a speaker! The symposium will consist of 20-30 participants. By deliberately having a limited number of participants, the symposium will contrast with the approach of large conferences. Typically, in large general conferences there are very many formally programmed speakers who each have only a small amount of time to explain their work in a panel where the presentations can sometimes have only limited connection, and there is even less time for discussion. By contrast, in this symposium the aim is to slow things down so that we have more time to think and converse in a relatively intimate setting, as well as make and renew valuable personal connections. We will have a small number of scheduled presentations on a relatively focused theme, which then allows generous time for an informal, challenging discussion by all participants around the table. In that sense, everyone is a speaker.
